Terms of Service

1. Agreement to Terms

By accessing or using weights.news ("the Service," "we," "us," or "our"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and weights.news. By using the Service, you represent that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. Description of Service

weights.news is a community-driven platform for sharing, discovering, and discussing AI-related news, research, tools, and resources. Users may submit links, upvote content, and participate in discussions through comments.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account using Google OAuth authentication. You agree to provide accurate information and keep your account credentials secure. You are solely responsible for all activity that occurs under your account.

3.2 Account Termination

We may suspend or terminate your account at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. You may delete your account at any time by contacting us.

4. User Content

4.1 Definition

"User Content" means any content you submit, post, or transmit through the Service, including but not limited to links, titles, descriptions, comments, and profile information.

4.2 Ownership

You retain all ownership rights in your User Content. weights.news does not claim ownership over any content you submit to the Service.

4.3 License Grant

By submitting User Content, you grant weights.news a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with operating and providing the Service.

This license includes the right for us to:

• Display your User Content to other users
• Format and organize your User Content for presentation
• Make your User Content available via RSS feeds and APIs
• Cache and archive your User Content for service reliability

This license terminates when you delete your User Content from the Service, except: (a) to the extent your User Content was shared with others who have not deleted it; (b) for copies we retain for legal compliance or backup purposes; and (c) for aggregated or anonymized data derived from your User Content.

4.4 Representations and Warranties

By submitting User Content, you represent and warrant that:

• You own or have the necessary rights to submit the content
• The content does not infringe any third party's intellectual property rights
• The content does not violate any law or these Terms
• You have the right to grant the license described above

4.5 Responsibility for User Content

You are solely responsible for your User Content. weights.news does not endorse any User Content and expressly disclaims any liability in connection with User Content. We are not obligated to monitor User Content, but we reserve the right to remove or disable access to any User Content at our discretion.

5. Acceptable Use Policy

You agree NOT to use the Service to:

5.1 Prohibited Content

• Submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Submit content that infringes any patent, trademark, trade secret, copyright, or other intellectual property rights
• Submit content containing malicious code, viruses, or harmful software
• Submit spam, unsolicited advertising, or promotional materials
• Submit misleading or fraudulent content
• Impersonate any person or entity

5.2 Prohibited Conduct

• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use any automated system (bots, scrapers, crawlers) to access the Service without our express written permission
• Circumvent, disable, or interfere with security features
• Manipulate voting or engagement metrics
• Create multiple accounts for deceptive purposes
• Violate any applicable laws or regulations

5.3 Enforcement

Violation of this Acceptable Use Policy may result in immediate termination of your account and potential legal action.

6. Intellectual Property

6.1 Service Content

The Service and its original content (excluding User Content), features, and functionality are owned by weights.news and are protected by copyright, trademark, and other intellectual property laws.

6.2 Trademarks

"weights.news" and associated logos are trademarks of weights.news. You may not use our trademarks without prior written permission.

6.3 Third-Party Links

The Service may contain links to third-party websites. We do not control and are not responsible for the content, privacy policies, or practices of third-party websites. Your interactions with third-party websites are governed by those websites' terms.

7. Copyright Policy (DMCA)

7.1 Respect for Intellectual Property

We respect the intellectual property rights of others and expect users to do the same. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA").

7.2 DMCA Takedown Notices

If you believe that content on the Service infringes your copyright, please send a notice to our designated DMCA agent containing:

1. A physical or electronic signature of the copyright owner or authorized agent
2. Identification of the copyrighted work claimed to be infringed
3. Identification of the material claimed to be infringing, with sufficient information to locate it
4. Your contact information (address, telephone number, email)
5. A statement that you have a good faith belief the use is not authorized
6. A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

7.3 Counter-Notification

If you believe your content was wrongly removed, you may submit a counter-notification containing:

1. Your physical or electronic signature
2. Identification of the removed material and its prior location
3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
4. Your name, address, telephone number, and consent to jurisdiction

7.4 Repeat Infringer Policy

We will terminate, in appropriate circumstances, users who are repeat copyright infringers.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service is free of viruses or harmful components

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEIGHTS.NEWS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any User Content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE MONTHS.

10. Indemnification

You agree to defend, indemnify, and hold harmless weights.news, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: your access to or use of the Service; your User Content; your violation of these Terms; your violation of any third-party rights, including intellectual property rights; or your violation of any applicable laws.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

11.2 Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. Judgment on the arbitration award may be entered in any court having jurisdiction.

The arbitration shall be conducted in English and held in San Francisco, California, or remotely via video conference at the election of either party.

11.3 Class Action Waiver

YOU AND WEIGHTS.NEWS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

11.4 Exceptions

Nothing in this section shall prevent either party from seeking injunctive or equitable relief in court for intellectual property infringement or misappropriation.

11.5 Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@weights.news within 30 days of first accepting these Terms.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and weights.news regarding the Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

12.5 Modifications

We reserve the right to modify these Terms at any time. Material changes will be notified by posting a notice on the Service or via email. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13. Platform Immunity Notice

weights.news is an interactive computer service within the meaning of Section 230 of the Communications Decency Act (47 U.S.C. § 230). We do not create or develop User Content. Pursuant to Section 230, no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.
